Turning a reduced settlement into long-term retirement income
CASE STUDY DETAILS
Finding financial opportunity after a legal setback
After years of litigation, a plaintiff faced an unexpected challenge when the appeals process reduced a substantial financial award. Continuing the legal battle could increase the recovery, but it would also add costs, delays, and uncertainty. Instead, the plaintiff chose to move forward and focus on making the available settlement proceeds support the next chapter of life.
Designing the structure
The financial strategy combined immediate cash distributions with a deferred, market-based structured settlement. The plan allocated cash distributions to address financial needs over the first five years. An additional $1.5 million was allocated to a deferred arrangement using the Vanguard investment option, with scheduled payments beginning five years after funding and continuing over a 15-year period. This approach provided near-term liquidity while keeping the deferred allocation invested, creating the potential for growth before and during the distribution period.
Modeling long-term outcomes
Using a hypothetical annual investment return of 5.25% after account fees, the illustration modeled a potential total benefit of approximately $3.02 million from the $1.5 million allocation. The structure included an illustrated baseline payment of approximately $99,933 annually over 15 years. Under the hypothetical return assumptions, projected annual payments increased from approximately $129,000 at the beginning of the distribution period to more than $326,000 in the final year. Actual payment amounts would depend on investment performance and the terms of the arrangement. The modeled figures are illustrative and are not guaranteed.
